1. Scope of Application

These General Terms and Conditions (Terms) govern the use of the Discord bot "Roasty.gg" and the associated website (hereinafter referred to as the "Service").

• Log in to the dashboard with Discord OAuth
• Subscribe to a premium plan

2. Service Description

2.1 Free Version (Free Tier)

The free version of Roasty.gg offers the following features:

• Basic roasts for games (League of Legends, Valorant, etc.)
• User roasts with limited usage
• Basic voice functions
• Dashboard access for bot configuration

2.2 Premium Version

The premium version extends the service with:

• Unlimited roasts
• Auto-troll function (automatic, time-controlled roasts)
• Advanced customization options
• Custom roast messages
• Priority support
• Early access to new features

2.3 Technical Requirements

To use Roasty.gg, you need:

• A Discord account
• Administrator rights on the Discord server (to add the bot)
• An ElevenLabs API key (for text-to-speech functions)
• A stable internet connection

3. Registration and User Account

3.1 Discord OAuth

Registration is exclusively via Discord OAuth. By logging in, you authorize us to receive the following data from Discord:

• Discord ID and username
• Email address
• Profile picture (avatar)
• Server list (only for bot management)

3.2 User Obligations

You agree to:

• Provide truthful information
• Keep your access credentials confidential
• Inform us immediately if you suspect third parties have access to your account
• Comply with Discord's Terms of Service

3.3 Account Deletion

You can delete your account at any time via:

• The dashboard under "Account Settings"
• Email request to [email protected]

After deletion, your personal data will be removed in accordance with our privacy policy.

4. Premium Subscription and Payment

4.1 Prices and Payment Terms

The current prices for premium subscriptions can be found on our pricing page.

• Monthly Subscription: 4,99€ per month

4.2 Payment Processing

Payment processing is handled by Stripe. Accepted payment methods:

• Credit card (Visa, Mastercard, American Express)
• Debit card
• SEPA direct debit
• Other payment methods supported by Stripe

4.3 Renewal and Billing

The premium subscription renews automatically:

• Monthly: Renewal every month on the same calendar day
• Annually: Renewal after 12 months

Charges are automatically processed using the stored payment method. You will receive an email notification before each charge.

4.4 Cancellation

You can cancel your premium subscription at any time:

• Via the dashboard under "Subscription"
• Directly through your Stripe Customer Portal
• By email to [email protected]

The cancellation takes effect at the end of the current billing period. You can continue using all premium features until then. No prorated refunds are provided for early cancellation.

4.5 Failed Payments

In case of failed payments:

• You will be notified by email
• We will automatically retry the payment multiple times
• After 7 days without successful payment, your premium access will be paused
• After 30 days, the subscription will be automatically canceled

4.6 Price Changes

Price increases will be communicated to you at least 30 days in advance by email. You have the right to cancel the subscription extraordinarily before the price increase takes effect.

5. Right of Withdrawal (for Consumers)

5.1 Exclusion of the Right of Withdrawal

For digital content that is not supplied on a physical medium (e.g., downloads, digital subscriptions, or online access), the right of withdrawal expires once the performance of the contract has begun, provided that you have given your express consent and acknowledged that you thereby lose your right of withdrawal.

6. Usage Rights and License

6.1 License Grant

We grant you a non-exclusive, non-transferable, revocable right to use Roasty.gg for the duration of the contractual relationship.

6.2 Ownership

All rights to Roasty.gg, including software, design, trademarks, and content, remain with us. You only acquire usage rights.

6.3 Restricted Use

You may not:

• Reverse engineer or decompile the code
• Sell, rent, or sublicense to third parties
• Copy or create derivative works
• Circumvent or manipulate security measures
• Use for illegal purposes

7. User Conduct and Prohibited Content

7.1 Permitted Use

You agree to use Roasty.gg exclusively for private, non-commercial purposes and in accordance with applicable law.

7.2 Prohibited Content and Activities

It is strictly prohibited to use Roasty.gg for the following purposes:

• Illegal Content: Distribution or promotion of illegal activities
• Hate Speech: Racist, discriminatory, or inciting content
• Harassment: Bullying, stalking, or threatening other users
• Spam: Unwanted mass messages or advertising
• Malicious Software: Distribution of viruses, malware, or harmful links
• Fraud: Deception, phishing, or fraudulent activities
• Copyright Violations: Use of protected content without authorization
• API Abuse: Overload, DDoS attacks, or similar activities

7.3 Custom Roast Messages

When using the custom roast messages feature (Premium), you are responsible for ensuring that they:

• Do not violate personal rights
• Are not offensive, discriminatory, or inciting
• Do not violate third-party copyrights
• Comply with Discord Community Guidelines

8. Availability and Technical Support

8.1 Availability

We strive for high availability of Roasty.gg, but cannot guarantee 100% uptime.

Planned maintenance work will be announced in advance on our Discord server.

8.2 Exclusion of Availability

We are not liable for outages due to:

• Force majeure (natural disasters, wars, pandemics)
• Third-party failures (Discord, ElevenLabs, hosting providers)
• DDoS attacks or other cyber attacks
• Maintenance work or necessary updates

8.3 Support

Free Users:

• Community support via our Discord server
• FAQ and documentation on the website
• Response time: Up to 48 hours

Premium Users:

• Priority support via email and Discord
• Response time: Within 24 hours (weekdays)
• Direct contact with the development team

9. Liability and Warranty

9.1 Limitation of Liability

We are only liable for damages caused intentionally or through gross negligence by us or our agents.

Liability for slight negligence is excluded, except in cases of:

• Injury to life, body, or health
• Breach of essential contractual obligations
• Claims under product liability law

9.2 Warranty

We do not warrant that:

• Roasty.gg will function error-free or uninterrupted
• Errors will be corrected
• The service meets your specific requirements

9.3 No Liability for Third Parties

We assume no liability for:

• Outages or errors of Discord
• Problems with the ElevenLabs API
• Costs incurred by ElevenLabs
• Payment problems with Stripe

9.4 User Liability

You are responsible for:

• All activities under your account
• Damages resulting from violation of these Terms
• Legal violations through your custom content

You indemnify us from all third-party claims arising from your use.

10. Termination and Suspension

10.1 Ordinary Termination

By the User:

• Free version: At any time by removing the bot from the server or account deletion
• Premium: At any time at the end of the billing period

By Us:

• With 30 days' notice by email

10.2 Extraordinary Termination

Both parties may terminate the contractual relationship extraordinarily for good cause.

Good causes for us include in particular:

• Serious or repeated violations of these Terms
• Use of the bot for illegal purposes
• Payment default of more than 30 days
• Violation of Discord Terms of Service

10.3 Consequences of Termination

After contract termination:

• All usage rights expire
• Your personal data will be deleted according to our privacy policy
• There is no claim for refund of amounts already paid
• You can use all features until the end of the paid period

11. Changes to Terms of Service

We reserve the right to change these Terms at any time, particularly in case of:

• Changes in legislation
• New features or services
• Security updates
• Changes to our business processes

11.1 Notification

Substantial changes will be communicated to you at least 30 days in advance:

• By email to your registered address
• Through a popup when logging into the dashboard
• On our website

11.2 Right to Object

You have the right to object to changes within 30 days of notification. Objection is equivalent to termination at the time the changes take effect.

12. Privacy

The protection of your personal data is important to us. All information about data processing can be found in our comprehensive Privacy Policy.

13. Final Provisions

13.1 Applicable Law

The law of the Republic of Austria applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict of laws rules of international private law.

13.2 Place of Jurisdiction

For disputes arising from this contractual relationship, the place of jurisdiction is our company's registered office, provided you are a merchant, legal entity under public law, or special fund under public law.

13.3 Severability Clause

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid provision.

13.4 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are not obliged to participate in a dispute resolution procedure before a consumer arbitration board, but are generally willing to do so.
